  • Taxes & Shipping: For physical products, you are responsible for paying all applicable shipping fees and state/local taxes assessed at checkout. Delivery dates for physical items are estimates and not guaranteed.
  • Refunds & Returns: Returns, exchanges, and refund requests for physical and digital products are governed separately by our [Refund and Return Policy], which is incorporated into these Terms by reference.

3. Software Downloads & Digital Products License

  • Limited License: If you download software or digital files from our Services, we grant you a limited, non-exclusive, non-transferable, revocable license to use the software solely for your personal or internal business use, subject to these Terms.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, SOFTWARE, OR PRODUCTS.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

  • Arbitration & Class Action Waiver: Any dispute, claim, or controversy arising out of or relating to these Terms, software downloads, or physical goods purchases shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). You agree to resolve all disputes on an individual basis and waive any right to bring or participate in a class action lawsuit or class-wide arbitration.

10. Severability and Modifications

  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
  • Changes to Terms: We reserve the right to modify or update these Terms at any time. We will notify users of material changes by updating the “Last Updated” date at the top of this document. Continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
